Procedure to Auction Excess Fill Dirt

- All District property will be sold via competitive public oral auction
unless a qualified sale to a government agency.
- Legal notices of the public auction must be advertised for a reasonable
amount of time.
- Send the Flood Control District a letter stating your commitment to purchasing the subject dirt
should it be taken to public auction, and your willingness to submit an earnest
money deposit with the District to bring it to auction. The earnest money
is an approximate expense of the advertising and associated costs involved
to bring it to auction.
- The District reconfirms the dirt is available and that it can be sold
at auction by initiating a request for availability of selling the subject
property. The Project Management branch makes this determination.
- We allow 30 days for this process.
- If it is determined, after this review period, that the dirt is available
and that it may be sold, Property Management contacts you and requests you
to remit the earnest money deposit.
- After the approval is received, an auction date is set and advertising
begins.
- The auction will begin at a sale price of $0.00 with bid increments in
the amount of $0.05.
- Disposition of earnest money:
- If you are the successful bidder at the auction, you are still responsible
for the associated costs of the auction (as all successful buyers are),
and will be credited with the balance of your deposit toward the actual
purchase price.
- If the lowest bid is $0.00 then the balance of your deposit money will
be returned to you at the completion of the dirt removal.
- If you are out-bid at the auction, you will receive your deposit money
back.
- If you or no one else bids at the auction, you forfeit all of your earnest
money.
- If you are still interested in pursuing the purchase of the property
you have inquired about, please send the letter, formatted with the information

- On the day of the auction, an earnest money cashier's check is required from each bidder (unless previously submitted).
- All dirt removed from District property by the successful bidder is subject
to grading, sloping and pitch and depth requirements, determined and supervised
by the Project Management and Construction Management branches.
- There will be no core sampling or drilling allowed on site, without the
prior written consent of the Flood Control District Property Management office.
- The successful bidder is required to post a performance bond, based on
the amount of dirt required, to insure all work is preformed and completed
to District standards.
- A bid packet covers the requirements for the auction, the terms of the
auction and conditions on how the dirt is to be sold and removed.
